Michael Jordan Testifies He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial
The basketball icon, introducing himself formally in a Charlotte court on Friday, stated that his drive to win and novelty within the sport emboldened his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.
Team Investment and a Will to Win
The owner disclosed financial and corporate details of his racing venture, saying he put in $40m of his own funds into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “As a newcomer, I had no fear. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at from a different view.”
The Core Dispute: Charter Agreements and Renewal Demands
The heart of the case involves the end of a 2016 deal where Nascar provided each team a franchise. This system mirrors other major leagues with separately owned franchises, such as the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and left the court to a media frenzy, with fans and media clamoring for a glimpse or a picture of the global icon.
Leading the Legal Charge
Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan said is unlawful to keep two hands on the wheel.
At issue for Jordan and Heather Gibbs, who testified before Jordan, are events from September 2024. Gibbs described a hectic and tense period where the racing circuit told teams they had to sign a charter agreement extension. The document consists of 112 pages detailing team compensation and a guaranteed entry in every race.
A Refusal to Sign
Jordan explained that 23XI and Front Row Motorsports decided their only feasible option was to refuse a signature that extensive document and take the issue to court. All other teams signed the agreement.
Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or extension options. Nascar wasn’t talking, Jordan said.
The Bottom Line: Victory
But in the end, the resistance against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Success.
“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, noting that he purchased another franchise late in 2024 for $28m amid the legal dispute. “So I took the plunge.”
Account from the Gibbs Family
Heather Gibbs detailed her push for indefinite franchises, submitted in a written letter to Nascar. She testified the timing of the contract signing demand didn’t sit well.
She said, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader refused the appeal.
“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If I have 30, I have 30.”
